Claim Filing Requirements

I. DISQUALIFICATION

NOTE: The term "reopen" has been used in place of "file an additional claim" or "file a reopened claim," as the technical difference is lost to the claimant. In this context, "reopen" means merely to start the claim again.

A. Denial of (Present) Right to File AC or NC - Not Unemployed

You indicate you wish to file a claim or reopen your prior claim. You are still employed full-time. After considering available information, the Department finds that you do not meet the legal requirements for filing a claim.

B. Denial of (Past) Right to File NC, AC, or RC - Not Unemployed

When you filed your claim, you were still employed full-time. After considering available information, the Department finds that you do not meet the legal requirements for filing a claim.

C. Denial of Right to File - Outside the U.S.

(Enter Code Section 1253a, issue IRR)

You are presently living in (enter name of country). The United States has no formal agreement to accept claims from your country of residence. You do not meet the legal requirements for filing a claim.

D. Denial of Right to File NC as of a Requested Date - Partial Program

(Enter Code Section 1253a, issue IRR)

You wish to file a claim using a document issued to you by your employer. These documents are valid only for 28 days from the date they are issued. Available information indicates that you did not submit the document within the 28 days and you do not meet the legal requirements for filing a claim effective (date).

INCORRECT LAST EMPLOYER RDs

E. Incorrect Last Employer - New Claim

The Department has determined the employer you reported as your last employer at the time you filed your unemployment claim, [name of employer claimant reported as last employer], was not your last employer. We have attempted to contact you, however you have not responded to our requests for information regarding the name and address of your last employer. After considering available information, the Department finds you do not meet the legal requirements for filing a claim.

F. Incorrect Last Employer - Additional Claim.

The Department has determined the employer you reported as your last employer at the time you requested to reopen your unemployment claim [name of employer claimant reported as last employer], was not your last employer. We have attempted to contact you, however you have not responded to our requests for information regarding the name and address of your last employer. After considering available information, the Department finds you do not meet the legal requirements for reopening your claim.

G. Incorrect Last Employer - Claimant Provided Name of Incorrect Last Employer, But Subsequently Provided Correct Last Employer

You are required to provide the name and address of your last employer when you file a claim for unemployment insurance benefits. You reported (name of last employer reported by the claimant) was your last employer when you filed your claim. The Department has determined that an employer/employee relationship did not exist per Section 621(b) of the UI Code.

You subsequently provided the name of your correct last employer (enter correct last employer as determined by the TAX office); therefore, the disqualification under 1253a is removed.

NOTE: This RD is always used in conjunction with a VQ or MC disqualification connected to the "new" correct last employer. The purpose of this RD is to both notify the claimant that the Department has changed the last employer and give the claimant a chance to appeal the Department’s decision regarding that change.

Use this RD when the TAX office has determined that the last employer reported by the claimant at either the NC or AC point:

  • was not the correct last employer because there was not an employer/employee relationship and,
  • the reason the claimant is no longer working for the correct last employer is disqualifying.

The Department is required to notify your last employer when you file or reopen your unemployment claim. The United States Postal Service could not deliver the notice to the employer address you provided when you filed your claim. You are required to provide the name and address of your last employer. You have not responded to our request(s) for information needed to decide your eligibility. You do not meet the legal requirements for payment of benefits.

INCOMPLETE CONTINUED CLAIM FORM

I. Incomplete Continued Claim Form

On your continued claim for the week(s) ending (enter Week Ending dates from claim form) you did not answer one or more questions or you answered one or more questions as both "yes" and "no." You have not responded to our request(s) for information needed to decide your eligibility. You have not given the Department enough information to decide if benefits can be paid.

J. Incomplete Claim Information

When you filed your claim, you refused to supply information necessary to complete your application. After considering available information, the Department finds that you do not meet the legal requirements for filing a claim.

A1. Failure to Respond to Request for ID documents - Unable to Determine Identity

You failed to respond to the Department’s request to provide copies of documents that will confirm your identity as required by Regulations. You did not provide a copy of a government issued photo identification which contains your photograph, first and last name, and date of birth, and a copy of one additional identity verification document which contains either your social security number verification, date of birth verification, address verification, or employment data verification to confirm your identity. Until a photo identification and one additional identity verification document are received, the Department finds that you do not meet the legal requirements for payment of benefits.

B1. Failure to Provide a Photo ID - Unable to Determine Identity

You failed to submit a government issued photo identification to confirm your identity as required by Regulations. Until a copy of a government issued photo identification which contains your photograph, first and last name, and date of birth is received, the Department finds that you do not meet the legal requirements for payment of benefits.

C1. Provided an Illegible Photo ID - Unable to Determine Identity

The information on the photo identification you submitted can not be read in order to confirm your identity as required by Regulations. Until a readable copy of a government issued photo identification which contains your photograph, first and last name, and date of birth is received, the Department finds that you do not meet the legal requirements for payment of benefits.

D1. Provided an Invalid Photo ID - Unable to Determine Identity

The photo identification you submitted is not one of the acceptable identity verification documents requested by the Department to confirm your identity as required by Regulations. H1. Date of Birth Discrepancy - Unable to Determine Identity

The date of birth you provided to the Department does not agree with other government records and the Department is unable to confirm your identity as required by Regulations. Until you submit a copy of your birth certificate issued by a local, state, or federal agency, or a foreign government, or other official certification of birth, the Department finds that you do not meet the legal requirements for payment of benefits.

I1. Social Security Number Discrepancy - Unable to Determine Identity

The social security number you provided to the Department does not verify with Social Security Administration records and the Department is unable to confirm your identity as required by Regulations. Until you submit a copy of your annual statement issued to you by the Social Security Administration or a verification letter from the Social Security Administration Office, the Department finds that you do not meet the legal requirements for payment of benefits.

J1. Provided False Identity Information

You filed a claim for benefits that the Department has determined do not belong to you. The identity information that you provided is false. After considering available information, the Department finds that you do not meet the legal requirements for the payment of benefits.

II. ELIGIBLE

AA. "Last Employer" Status Questioned - Claimant Determined to be an Employee and Employer Provided No Separation Information

You have indicated that the claimant was not an employee. After considering available information, the Department finds that the claimant was an employee and that you were the last employer. You have ten days from the date of this notice to provide the Department with facts concerning the claimant’s separation from your employ.

BB. "Last Employer" Status Questioned - Claimant Determined to be an Employee and Employer Provided Separation Information
