Time Requirements for Filing Claims

I. DISQUALIFICATION

NOTE: The term "reopen" has been used in place of "file an additional claim" or "file a reopened claim," as the technical difference is lost to the claimant. In this context, "reopen" means merely to start the claim again.

A. Backdating Denied - No Good Cause

(Enter Code Section 1253a, issue IRR, and Reason for Decision MI10 A.)

You contacted the office to file your claim on (enter date). You have not shown you could not have reported during the week you want to claim. After considering available information, the Department finds that you do not meet the legal requirements for filing a claim beginning (enter date).

B. Backdating Denied - Good Cause Not Continuous

(Enter Code Section 1253a, issue IRR, and Reason for Decision MI10 B.)

You contacted the office to file your claim on (enter date). You have not shown you could not have reported before this date. After considering available information, the Department finds that you do not meet the legal requirements for filing a claim beginning (enter date).

C. Backdating Denied - Into Prior Benefit Year.

You have requested that your claim start (enter BYB date requested). Your old claim does not expire until (enter BYE of old claim). The earliest your new claim can be started is (enter BYB of new claim).

D. Backdating Denied - Over 65 Weeks

F. Late Filing of Continued Claim - Not Available For Interview

Information available to the Department indicates that you have not filed your claim form(s) in a timely manner. Your claim form(s) for the week(s) of (enter w/e date) was not received by the Department until (enter date scanned). Since you were not available for your telephone interview on (enter date), facts available to the Department do not show that you had good cause for submitting your claim form(s) late.

G. Missed Quality Control Interview

You were scheduled for an in-person Quality Control interview on (enter date of scheduled interview), as required by the Department. Since you did not appear at the interview and have not established good cause for your failure to report, you have not met the legal requirements for payment of benefits.
