I. DISQUALIFICATION

A. Insufficient Labor Market Due to Restrictions

B. Noncompelling Restriction

You will not work in your usual occupation because you believe it involves a risk to your safety or health. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

C. Unwilling to Accept Work Without Opportunity For Advancement

You will not accept work that does not offer an opportunity for advancement. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

D. Weather or Climate Restrictions

You will not work in certain weather or climatic conditions that are usual for your occupation. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

E. Lacks Required Equipment

You lack the necessary equipment to be employed in your customary occupation. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

F. Unable to Meet Governmental Requirement

You have placed limits on your customary work because you are unable to meet governmental requirements. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

G. Unable to Obtain License or Permit

You do not have the required license or permit to work in you customary occupation. You will not accept other work for which you are qualified. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

H. Unable to Meet Reasonable Employer Requirements

You are unable to meet a reasonable employer requirement which is used by nearly all employers in your occupation. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

I. Fails to Meet Grooming Standards

You have placed limits on your work by voluntarily adopting a mode of grooming or appearance which restricts the opportunity for work in your occupation. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

II. ELIGIBLE

AA. Sufficient Labor Market Despite Restrictions

You state the claimant may not be available for work because he/she will not work under certain working conditions. After considering available information, the Department finds the claimant is able and available for work.

BB. Will Not Work With Certain Individuals

You state the claimant may not be available for work because he/she has declined to work with certain individuals. After considering available information, the Department finds the claimant is able and available for work.

CC. Doesn’t Meet Employer Requirement

You state the claimant may not be available for work because he/she does not meet an employer requirement. After considering available information, the Department finds the claimant is able and available for work.

DD. Willing to Accept Other Work

You state the claimant may not be available for work because he/she does not meet governmental requirements for work. After considering available information, the Department finds that the claimant is able and available for work.

EE. Unable to Obtain License or Permit

You state the claimant may not be available for work because he/she does not have the required license or permit to work in his/her usual occupation. After considering available information, the Department finds the claimant is able and available for work.

FF. Restriction Because of Health or Safety Risk

You state the claimant may not be available for work because he/she is unwilling to work for a particular employer due to the belief of a health or safety risk. After considering available information, the Department finds the claimant is able and available for work.

GG. Lacks Required Equipment - Available for Other Work

You state the claimant may not be available for work because he/she lacks required equipment. After considering available information, the Department finds the claimant is able and available for work.
