Nonindustrial Disability Insurance

State employees are divided into 21 bargaining units. Nonindustrial Disability Insurance (NDI) covers excluded employees and rank-and-file employees in bargaining units 2, 5, 6, 7, 8, 9, 10, 12, 13, 16, 18, and 19.

State Disability Insurance (SDI) covers employees in bargaining units 1, 3, 4, 11, 14, 15, 17, 20, and 21. For more information, visit State Disability Insurance.

No. You cannot choose your disability program. It is determined by your employment position and bargaining unit.

Once benefits are authorized, you should direct questions about health, dental and vision benefits, payment status, weekly rates, payment amounts, deductions, etc., to your attendance clerk or personnel office.

Yes. Managers and supervisors participate in the NDI program (both the regular and enhanced benefit levels).

Yes. Your NDI benefits will be included as wages on your W-2.

Yes. If you are working reduced hours or modified duty due to a disability and you have a wage loss, you may be eligible for benefits.

If you are receiving NDI benefits, you will not accrue annual leave credits unless you work partial hours.

Yes. If you are in a covered bargaining unit and are otherwise eligible for NDI, you can file claims and receive benefits.

Yes. If you are on NDI, you can file an NDI-FCL claim as of July 1, 2019, when the new program starts. The EDD will determine eligibility. However, benefits for both programs cannot be paid on the same day.

Yes. There are circumstances when you are eligible for both, such as going from one bargaining unit to another. You could receive 50% from NDI and 50%, or up to your gross pay, from SDI.

Family Care Leave

Starting July 1, 2019, the Nonindustrial Disability Insurance (NDI) program is expanding to include Family Care Leave (FCL) for eligible state Government Employees, excluded from bargaining. Eligible employees will be able to take leave to care for a seriously ill family member or bond with a new child.

No, NDI-FCL does not require a waiting period to be served before benefits are payable.

Yes. If you are eligible for NDI-FCL, you can file a claim within one year of the birth, adoption, or placement of your new child. However, you would not be eligible to receive benefits before the program’s start date, July 1, 2019.

Yes. However, you will not receive benefits for your time off work to care for a family member before the program’s start date, July 1, 2019.

For example, if you are a caregiver to an eligible family member from March 2019 to November 2019, you may be eligible for six weeks of benefits starting July 1, 2019. You would not be eligible for benefits from March 2019 through June 30, 2019.

You can file both claims, but are only eligible to receive a maximum of 6 weeks (42 days) in a 12-month period. Both claims are cumulative and may not be used on the same day.

NDI-FCL benefits are only available to excluded employees who may not participate in the state’s Paid Family Leave program. Only excluded employees on annual leave may be eligible for these benefits.

NDI-FCL provides up to six weeks of benefits in a 12 month period for employees who need time off work to care for a seriously ill family member or bond with a new child through birth, adoption, or foster care placement.

ENDI provides up to 26 weeks of benefits for a qualifying medical disability and employees must serve a 7 or 10 day waiting period before benefits are paid.

Unlike the ENDI program, NDI-FCL does not require employees to serve a 7 or 10 day waiting period before benefits are payable.

Yes. The procedures for applying for these benefits, the roles and responsibilities of the personnel offices, and how the benefits are paid will be the same as the ENDI program.
