Appeals

If you are disqualified from receiving Disability Insurance (DI) or Paid Family Leave (PFL) benefits, you will receive an Appeal Form (DE 1000A) with your disqualification notice. You have the right to appeal any decision electronically or in writing within 30 days of the issue date of the notice from the State Disability Insurance (SDI) program.

Filing an Appeal

Complete the appeal form with a detailed explanation of why you believe the disqualification is in error. Mail your appeal to the return address shown on the decision notice.

If the form is lost or misplaced, you may also send the EDD a detailed letter. Be sure to include your:

  • Full printed name.
  • DI Claim Identification (ID) Number or EDD Customer Account Number.
  • Address.
  • Phone number.
  • Reason for your appeal.
  • Request for any language assistance or special accommodations.
  • Signature on the appeal letter.
  • Social Security number for appeals relating to PFL.

The EDD will evaluate the detailed facts you provide in your DE 1000A or appeal letter and notify you of our findings. If you provide additional information showing you are eligible for benefits, the EDD will issue payments on the claim, if funds are still available on the claim, and will advise you of the action taken.

If the EDD is not able to issue you payments, your appeal form or letter will be forwarded to the California Unemployment Insurance Appeals Board local Office of Appeals.

The Office of Appeals will mail you a notification with your hearing date, time, location, and their phone number. At the hearing, an impartial Administrative Law Judge will listen to both sides of the appeal and make a determination based on facts presented by you and by an SDI representative.

Filing a Voluntary Plan Appeal

If your Voluntary Plan (VP) denies benefits and you disagree with the denial, you have the right to appeal the decision and have a hearing before an impartial Administrative Law Judge.

To file an appeal, send SDI a detailed letter stating why you think the VP denial is incorrect. Be sure to include your:

  • Full printed name.
  • DI Claim ID Number or EDD Customer Account Number.
  • Date of birth.
  • Address.
  • Phone number.
  • The name of your employer.
  • Employer’s phone number.
  • Reason for your appeal.
  • Request for any language assistance or special accommodations.
  • Signature on the appeal letter.

The EDD will file the necessary appeal documents with the California Unemployment Insurance Appeals Board local Office of Appeals but will not pay SDI benefits in the interim nor attend the appeal hearing. It is important for you to attend your appeal hearing.

If you receive a Notice of Hearing and cannot attend, you should call the Office of Appeals that is handling your hearing to reschedule. If you fail to appear, the appeal will be dismissed.
